Please read these Terms carefully. By downloading or using Swipy, you agree to be bound by these Terms of Service. If you do not agree, do not use the app.

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Swipy Limited ("we," "us," or "our") governing your access to and use of the Swipy mobile application ("App") and any related services (collectively, the "Service").

By creating an account, accessing, or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Description of Service

Swipy is a restaurant discovery application that helps users find nearby restaurants through a swipe-based interface. The Service includes:

  • Location-based restaurant discovery using Google Places data
  • The ability to save restaurants to personal albums
  • A tournament mode to choose between saved restaurants
  • A multiplayer Battle Royale mode for group decision-making
  • Sharing restaurant recommendations with others

Restaurant information, photos, ratings, and other data displayed within the Service are sourced from Google Places API and are subject to change. We do not guarantee the accuracy, completeness, or timeliness of any restaurant information.

3. Eligibility

You must be at least 13 years of age to use the Service. By using Swipy, you represent and warrant that you are 13 or older. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

We do not knowingly collect personal information from children under 13. If we discover that a child under 13 has provided us with personal information, we will promptly delete it. If you believe a child under 13 has provided us with personal data, please contact us at support@swipyteam.com.

4. User Accounts

To access certain features of the Service, you must create an account. You may register using your email address or through Apple Sign In.

Your Responsibilities

  • Provide accurate and complete information when creating your account
  • Keep your account credentials secure and confidential
  • Notify us immediately of any unauthorized use of your account
  • Accept responsibility for all activities that occur under your account

We reserve the right to suspend or terminate accounts that violate these Terms, contain false information, or have been inactive for an extended period.

5. Acceptable Use

You agree to use the Service only for lawful purposes and in a manner consistent with these Terms. You must not:

  • Use the Service for any illegal or unauthorized purpose
  • Attempt to gain unauthorized access to any part of the Service or its related systems
  • Reverse engineer, decompile, or disassemble the App or any portion thereof
  • Use automated scripts, bots, or scrapers to interact with the Service
  • Interfere with or disrupt the integrity or performance of the Service
  • Transmit any viruses, malware, or other harmful code
  • Impersonate any person or entity or misrepresent your affiliation with any person or entity
  • Use the Service in a way that could damage, disable, or impair our servers or networks

6. Third-Party Services

The Service integrates with and relies on third-party services. Your use of these services is subject to their respective terms and privacy policies:

Google Places API

Restaurant data, names, addresses, photos, and ratings are provided by Google Places API. By using the Service, you also agree to Google Maps/Places Terms of Service (https://developers.google.com/maps/terms).

Supabase

User authentication and profile data are processed by Supabase, Inc. See Supabase's Privacy Policy (https://supabase.com/privacy) for details.

Apple Sign In

If you choose to sign in with Apple, your use of Apple authentication services is governed by Apple's Terms of Service and Privacy Policy.

We are not responsible for the availability, accuracy, or practices of any third-party services. Links or integrations with third-party services do not constitute endorsement.

7. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of Swipy Limited and its licensors. The Service is protected by copyright, trademark, and other laws.

Restaurant names, photos, and related data displayed in the app are owned by their respective rights holders or licensed through the Google Places API. We do not claim ownership of restaurant content.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use. You may not copy, modify, distribute, sell, or lease any part of the Service.

8. Disclaimers

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied. We explicitly disclaim all warranties, including:

  • Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
  • That the Service will be uninterrupted, error-free, or free of viruses or other harmful components
  • The accuracy, reliability, or completeness of restaurant information, hours, prices, or photos
  • That the Service will meet your specific requirements

Restaurant information is sourced from third-party providers and may be outdated, incomplete, or inaccurate. Always verify restaurant details directly before visiting.

9. Limitation of Liability

To the fullest extent permitted by applicable law, Swipy Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Loss of profits, revenue, data, or goodwill
  • Personal injury or property damage arising from your use of the Service
  • Any unauthorized access to or alteration of your data
  • Damages resulting from reliance on restaurant information displayed in the app

Our total cumulative liability to you for any claim arising out of or related to the Service shall not exceed the greater of (a) the amount you paid us in the twelve months prior to the claim, or (b) USD $50.

10. Indemnification

You agree to defend, indemnify, and hold harmless Swipy Limited and its officers, directors, employees, and agents from any claims, liabilities, damages, judgments, awards, costs, or expenses (including reasonable attorneys' fees) arising out of or relating to:

  • Your use of the Service in violation of these Terms
  • Your violation of any third-party right, including intellectual property or privacy rights
  • Any content you share through the Service

11. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.

You may terminate your account at any time by contacting us at support@swipyteam.com or through the account deletion option in the App settings.

Upon termination, your right to use the Service immediately ceases. Provisions that by their nature should survive termination (including Intellectual Property, Disclaimers, Limitation of Liability, and Governing Law) shall survive.

12. Changes to Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will notify you by updating the "Last updated" date at the top of these Terms and, where appropriate, by sending a notification through the App or via email.

Your continued use of the Service after any changes constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Service.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions.

Any dispute arising from these Terms or your use of the Service shall be resolved exclusively in the courts of England and Wales, and you consent to personal jurisdiction in those courts.
